Nowadays, the image rights has a strong penetration in daily life, thanks mainly to the media. The growing improvement of different medias and the increasingly frequent association of the people image for publicity are some of those image exploitation and many lawsuits due to its incorrect use.

 

Concerned about the demand for resources in this regard, the Brazilian Superior Court of Justice published in October 2009, a summary that deals with compensation for the unauthorized used images. Number 403, the summary is worded as follows: “The indemnity for the unauthorized image publications of a person for economic or commercial purposes is independent of damage proof”. Therefore, the photographer needs the lifemodel´s authorization to share, sell and exhibit the image. It is important the formal authorization contains information on where the image will be served, for what reason (s) and at what time and period of publication.
